These Terms and Conditions govern the sale of goods through the website biancaandnoe.com (the “Site”). Please read them before placing an order. By placing an order you accept these Terms.

In these Terms, “we”, “us” and “Bianca&Noè” mean the company above; “you” means the customer.

2. Who can buy

You may place an order if you are 18 or older and are acting as a consumer, that is, for purposes outside your trade, business or profession. Orders for resale are not accepted through the Site; for wholesale please write to wholesale@biancaandnoe.com.

You can order with or without creating an account. Creating an account is optional.

3. Where we sell and ship

We sell and ship to: Italy (including San Marino and Vatican City), the European Union (Monaco included; the Canary Islands, Ceuta and Melilla excluded), the United Kingdom, and Switzerland and Liechtenstein. We ship from a single warehouse in Italy. We do not currently accept orders from, or ship to, any other country.

4. Products

Our garments are made in Italy in limited quantities. Photographs and colour descriptions are as accurate as we can make them, but colours may appear differently on different screens and natural fabrics may show slight, non-uniform variations. These are characteristics of the material, not defects.

Product pages show the fibre composition and care instructions for each garment. Availability is shown in real time but is not guaranteed until we confirm your order (clause 6).

5. Prices

All prices are shown in euro (€) and include Italian VAT.
The price you see is the price you pay, plus shipping where applicable (clause 9).
Prices do not include import duties, import VAT or customs clearance fees for deliveries outside the European Union — see clause 9.
We may change prices at any time, but a change never affects an order we have already confirmed.
If a price is obviously wrong, we may refuse or cancel the order and refund you in full; we will tell you as soon as we notice.

6. How the contract is made

Product listings on the Site are an invitation to buy, not a binding offer.
You add items to your cart, go to checkout, enter your details, choose a shipping and payment method, and place the order by clicking the payment button. Clicking that button places an order with an obligation to pay.
You will then receive an order acknowledgement by email. This confirms we have received your order; it is not yet acceptance.
The contract is concluded when we send you a shipping confirmation for the items in question.
Before placing the order you can review and correct your details and the contents of your cart at any point in the checkout.
We store the contract data and send you a copy of these Terms by email. If you lose it, write to shop@biancaandnoe.com and we will send it again.
These Terms are available in English and Italian. You may conclude the contract in either language.

7. If we cannot fulfil your whole order

If an item turns out to be unavailable, we will tell you and send the rest of the order, refunding the unavailable items in full. If you would rather cancel the whole order, tell us within 10 days of that message and we will refund everything, shipping included.

8. Payment

We accept the payment methods shown at checkout. Payment is taken when the order is placed. We do not process an order until payment has been authorised.

9. Delivery, shipping costs and customs

Full details are in our Shipping Policy, which forms part of these Terms. In summary:

Italy (incl. San Marino, Vatican City): € 7 — free from € 150
European Union (incl. Monaco): € 11 — free from € 200
United Kingdom, Switzerland, Liechtenstein: € 15 — free from € 250

Shipping charges include VAT. We do not ship on Saturdays, Sundays or Italian public holidays.

Delivery times. We dispatch within 1–2 working days of the contract being concluded. Estimated delivery after dispatch: Italy 1–3 working days; European Union 3–6 working days; United Kingdom and Switzerland 4–8 working days, plus customs clearance. These are estimates. In any case we will deliver within 30 days of the contract being concluded, unless we agree otherwise with you. If we miss that deadline, you may give us a reasonable additional period and, if we still fail, cancel the order and receive a full refund.

Risk. The goods remain at our risk until they are delivered to you (or to the person you have named to receive them). If a parcel arrives damaged or is lost in transit, contact us and we will sort it out.

Customs, duties and import VAT (United Kingdom, Switzerland and Liechtenstein). Orders to these destinations are shipped DDU / DAP: import VAT, duties and carrier clearance fees are not included and are paid by the recipient on delivery. Amounts are set by the destination country, not by us, and we cannot estimate them in advance. If you refuse the parcel or do not pay these charges, the parcel is returned to us: we will refund the price of the goods, less the original shipping cost and the cost of returning the parcel to Italy, which we will deduct from the refund.

10. Your right to cancel (right of withdrawal)

You have 14 days to change your mind, with no reason and no penalty. The full procedure, including the model cancellation form, is in our Returns and Right of Withdrawal Policy, which forms part of these Terms. The same 14-day right applies to customers in the United Kingdom, Switzerland and Liechtenstein, even where local law does not require it.

11. Legal guarantee of conformity

We are liable for any lack of conformity of the goods existing at delivery and becoming apparent within two years of delivery. This is a legal right, it is free of charge, and it exists alongside — and is not replaced by — any commercial guarantee. Details are in our Returns and Right of Withdrawal Policy.

12. Complaints and dispute resolution

Write to shop@biancaandnoe.com. We aim to reply within 2 working days and to resolve complaints within 14 days.

If we cannot settle a dispute directly, you may use an alternative dispute resolution (ADR) body under Part V, Title II-bis of the Italian Consumer Code (Legislative Decree 206/2005). We are not currently a member of an ADR scheme and are not obliged to be, but we will consider any ADR proposal in good faith.
Consumers resident in the EU can get free assistance from the European Consumer Centres Network (ECC-Net).
The European Online Dispute Resolution (ODR) platform closed on 20 July 2025 and is no longer available.

13. Governing law and jurisdiction

These Terms are governed by Italian law. This does not deprive you of the protection given to you by the mandatory consumer law of the country where you live. As a consumer you may bring proceedings in the courts of the place where you are resident or domiciled, and we will bring any proceedings against you there.

14. Your account

If you create an account, keep your password confidential and tell us at once if you think someone else has access to it.

15. Personal data

We process your personal data in accordance with our Privacy Policy and Cookie Policy. Placing an order does not give us consent to send you marketing; newsletters are sent only if you sign up separately, and you can unsubscribe at any time.

16. Intellectual property

All content on the Site — images, texts, prints, patterns, the Bianca&Noè name and logo — belongs to Bianca&Noè S.r.l. or its licensors. You may not reproduce or use it commercially without our written consent.

17. Changes to these Terms

We may update these Terms. The version that applies to your order is the one published on the Site when you place it, and we will send you a copy with your order acknowledgement.

18. Invalid clauses

If any clause of these Terms is found to be invalid, the rest remains in force.
